Who we are
These terms are an agreement between you and {{COMPANY_LEGAL_NAME}}, {{COMPANY_ADDRESS}} (“we”, “us”). Contact: [email protected]. More details are in the imprint.
What these terms cover
These terms apply to:
- the Tallyfall app for iOS and Android,
- the Tallyfall Kids app for iOS and Android,
- the web game at tallyfall.com/play,
- the website tallyfall.com.
Schools and teachers using the teacher panel at teach.tallyfall.com also accept the School licence terms.
How we handle your data is explained in the Privacy Policy, the Kids privacy notice and the Schools privacy notice.
The service
Tallyfall is a game in which numbered tiles fall onto a board and you connect neighbouring tiles that match a rule. There is a Play mode for everyone and a Learn mode with maths topics. We may improve, change or remove features over time. We will not take away content you have paid for without a fair replacement or refund, unless the law allows it.
Your account and nickname
You do not need an account. Your progress is linked to a random, anonymous device key. If you delete the app or clear your browser data, progress that only exists on your device may be lost.
If you choose a nickname, it must not be offensive, misleading or someone else’s real name or brand. We may change or remove nicknames that break these rules. In Tallyfall Kids, nicknames are picked from a fixed list.
Fair play
You agree not to:
- cheat, for example by changing the game, its files or its network traffic,
- use bots, scripts, macros or any other automated way to play or to submit scores,
- exploit bugs to gain scores or content; please report them to [email protected] instead,
- attack, overload or try to break into our servers,
- copy, sell or redistribute the game or its content,
- use Tallyfall in a way that breaks the law or harms others.
If you break these rules, we may remove scores, reset leaderboard entries or block access to online features.
Purchases, virtual goods and refunds
- What you can buy. In Tallyfall: Remove ads, themes, a bundle and the full Learn topic map. In Tallyfall Kids: the full version, as a one-time purchase behind the parental gate. Prices are shown in the app store before you buy.
- No advantage. Purchases unlock no-ads play, content and looks. They never make you stronger in the game or on leaderboards.
- Licence, not ownership. What you buy is a personal, non-transferable right to use the content in the app. It has no cash value and cannot be exchanged for money.
- Payment. Purchases in the apps are made through the Apple App Store or Google Play. Their terms apply to the payment.
- Refunds. Refunds for app purchases are handled by Apple or Google under their refund policies. Our purchase help explains how to ask for one.
- Restoring purchases. Use Restore purchases in the app settings to get your purchases back on a new device with the same store account.
- Ads. The free Tallyfall app shows ads between games. See the Privacy Policy for how ads and consent work.
If you live in the EU, you have the right to withdraw from a purchase within 14 days. For digital content that is delivered immediately, you agree when you buy that the content starts right away, and you accept that you lose the right of withdrawal from that moment, as the law allows.
Our content
The Tallyfall game, its name, logo, design, levels, texts, sounds and code belong to us or our licensors and are protected by copyright and trademark law. You may use them for your own personal play. Teachers may use the game and screenshots in the classroom. Press material is available on our press page. Anything else needs our written permission: [email protected].
Availability
We work hard to keep Tallyfall running, but we cannot promise that online features (such as leaderboards or the daily challenge) are always available or free of errors. Most of the game also works offline.
Liability
We are fully liable for damage caused intentionally or through gross negligence, and for injury to life, body or health.
For slight negligence, we are only liable if we breach an essential obligation of these terms, and only for the typical, foreseeable damage. Otherwise, to the extent the law allows, we are not liable for slight negligence.
Nothing in these terms limits liability that cannot be limited by law.
Your consumer rights
If you are a consumer, nothing in these terms takes away the rights you have under the mandatory consumer protection law of the country where you live.
Governing law
These terms are governed by {{GOVERNING_LAW}}. If you are a consumer, this choice of law does not remove the protection of the mandatory rules of the country where you live, and you can also bring a claim in the courts of that country.
Changes to these terms
We may update these terms, for example when we add features or the law changes. We will tell you about important changes in the app or on the website before they take effect. If you keep using Tallyfall after that, the new terms apply.
